Specialist Auckland Parole and Recall Lawyer

Need a parole lawyer? At MutchLaw, we are experienced with helping clients that have been charged with breaching the conditions of their parole or breaching any other court order or sentence. If you have been recalled for breaching parole and need a lawyer to represent you, I can assist with this process too. I can also represent you if you have breached home/community detention or community service orders.

In NZ, the decision to grant parole to long-term prisoners (those serving a determinate sentence of over two years) is made by the NZ Parole Board, and the Parole Board is guided by the Parole Act 2002. In determining whether release on parole is appropriate, the Parole Board needs to be satisfied on reasonable grounds that the prisoner will not pose an undue risk to the community or any person. The Parole Board will also impose any release conditions required when granting parole. Having a lawyer present to advocate on your behalf to the Parole Board can help immensely in securing a favourable outcome. A lawyer can also ensure that the Parole Board receives all the relevant information that they need to make their decision prior to the appearance. It’s also important to feel confident that your legal rights are being met. A parole hearing is a stressful time for all parties involved, so having a lawyer present for the hearing can help alleviate that stress and ensure that all information is placed before the Parole Board both in written and oral submissions.
